This Copyright & DMCA Policy describes how Podcast Delivery (“we”, “us”, “our”), operated by Orishnal Digital Services, handles intellectual property, copyright disputes, takedown notices, and permitted use of material across podcastdelivery.com, deals.podcastdelivery.com, the newsletter, the deals directory, and all related Services (“Services”).
1. Ownership of Site Content
All content created by Podcast Delivery—including text, design, layout, graphics, branding, compilations, formatting, and proprietary databases—is owned by Podcast Delivery or licensed to us.
You may not:
- Copy or redistribute any part of the Services
- Aggregate or scrape data from the directory
- Reproduce or frame our pages
- Republish our content elsewhere
- Use our trademarks or trade dress without permission
All rights are reserved.
User Content is subject to its own section below.
2. User Content & License
Users may submit:
- Podcast descriptions
- Images, artwork, titles, and metadata
- URLs, social links, and promotional material
- Reviews, commentary, and written submissions
2.1 Ownership
You retain ownership of your User Content.
2.2 License to Us
By submitting content, you grant Podcast Delivery a worldwide, nonexclusive, royalty-free license to:
- Store, reproduce, and display your content
- Modify and format it for display
- Publish it across our Services
- Use it for operations, improvements, and promotional purposes
- Generate summaries, metadata, and enriched content using AI processors
This license ends when your content is removed, except where retention is required for compliance or backup integrity.
3. Prohibited Intellectual Property Uses
You may not submit or upload content that:
- Infringes any copyright, trademark, or proprietary right
- Contains unlicensed music or artwork
- Violates another party’s publicity or privacy rights
- Misrepresents authorship or ownership
- Circumvents DRM or distribution restrictions
We may remove any content at our discretion.
4. DMCA Compliance (USA)
We comply with the Digital Millennium Copyright Act (“DMCA”) and accept formal takedown notices.
If you believe your copyrighted material has been used without permission, you may submit a DMCA notice by email.
4.1 DMCA Takedown Notices Must Include:
- Your name, address, phone number, and email
- Identification of the copyrighted work
- Identification of the material to be removed (URL required)
- A statement of good-faith belief that use is unauthorized
- A statement made under penalty of perjury that the notice is accurate
- Your physical or electronic signature

5. Counter-Notification
If your content is removed due to a DMCA notice, you may file a counter-notification.
A valid counter-notice must include:
- Your name, address, phone number, and email
- Identification of the removed content and its previous location
- A statement under penalty of perjury that the removal was mistaken
- Consent to jurisdiction in your residence or British Columbia, Canada
- Your electronic or physical signature
If the original complainant does not file a legal action within 10–14 business days, we may restore the content.
6. Repeat Infringer Policy
We may suspend or terminate accounts of users who:
- Repeatedly infringe copyright
- Submit infringing material
- Misuse intellectual property of others
- Abuse the DMCA process
We reserve the right to determine what qualifies as a repeat infringer.
7. Anti-Scraping & Automated Access Restrictions
To protect our content, data integrity, and partner agreements, you may not:
- Scrape, crawl, or index the site
- Use bots or automated tools
- Collect or aggregate deal information without permission
- Reverse-engineer our underlying APIs or data sources
- Repurpose deal listings or structured data
Violations may lead to account termination, legal action, or referral to partner networks.
8. Copyright for AI-Generated or Enriched Content
We use third-party AI services for:
- Metadata generation
- Content summarization
- Formatting
- Image/logo retrieval
- Enrichment around user-submitted content
We do not claim copyright over your original material.
However, enriched or derivative content generated by the system may be owned by Podcast Delivery.
AI processors do not use your data to train foundation models.
